THE LAW NO. 33/2015 REGARDING THE MODIFICATION OF THE LAW NO. 363/2007 CONCERNING THE TRADESMEN’S CONTROL OF THE UNFAIR PRACTICES IN THEIR RELATIONSHIP WITH THE CONSUMERS AND THE REGULATIONS HARMONIZATION WITH THE EUROPEAN LEGISLATION CONCERNING THE PROTECTION OF THE CONSUMERS PRESCRIBES BIGGER FINES FOR THE UNITS USING CHEATING AND AGGRESSIVE COMMERCIAL PRACTICES, AS FOLLOWING:
- fines from 5000 RON to 100.000 RON, for cheating commercial practices;
- fines from 2000 RON to 100.000 RON, for aggressive commercial practices.
A cheating action contains false information or misleads or it is susceptible to mislead the medium consumer, in a way that determines or is susceptible to determine the consumer to make a decision to close a transaction that wouldn’t have been made otherwise.
A commercial practice is considered a cheating omission if, in the context of the facts presentation, is omitted an essential information necessary for the medium consumer to make a decision concerning the closure of a transaction that wouldn’t have been made otherwise.
