REGULATION (EU) NO. 1052/2013 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL OF 22 OCTOBER 2013 ESTABLISHING THE EUROPEAN BORDER SURVEILLANCE SYSTEM (EUROSUR)

The European Commission established the European Border Surveillance System (hereinafter referred as EUROSUR), necessary in order to strengthen the exchange of intercommunity information with significant implications for reaction capability at external borders of the Members States of European Union for the purpose of combating illegal immigration.

The EUROSUR prerogatives shall be established in the field of external, terrestrial and maritime border surveillance, for detecting, identifying, monitoring, intercepting ant preventing the unauthorized crossing of the territorial boundaries. The EUROSU System shall also apply to the surveillance of air borders if Member States voluntarily provide the concerned information.

For EUROSUR implementing, Member States shall found National Coordination Centers and shall create communication networks, national situational pictures, The European situational picture and the common pre-frontier intelligence picture, in order to the uniform application of surveillance instruments.

The personal data processed in the European situational picture and the common prefrontier intelligence picture will concern only the ships identification numbers.

The personal data shall be processed only in purpose of detecting, identifying and tracking vessels and they shall be deleted within maximum 7 days since receipt. In case that the detecting and tracking period is extended, personal data will be deleted within no more than 2 months since receipt.
Starting with 02 December 2013, Bulgaria, Estonia, Greece, Spain, France, Croatia, Italy, Cyprus, Latvia, Lithuania, Hungary, Malta, Poland, Portugal, Romania, Slovenia, Slovakia and Finland shall establish National Coordination Centers, and for the other Member States of European Union the community duty shall become incidence starting with 01 December 2014.
Regulation (EU) no. 1052/2013 of the European Parliament and of the Council is obligatory and directly applicable in all States Members of the European Union.
