THE ROMANIAN OFFICIAL GAZETTE, FIRST PART, NO. 461 OF THE 24TH OF JUNE 2014, HOLDS PUBLISHED THE GOVERNMENT’S EMERGENCY ORDINANCE NO. 35/2014 FOR THE COMPLETING OF THE LAW FOR ELECTRICITY AND NATURAL GAS NO.123/2012.

According to the Emergency Ordinance, starting with the 15th of July 2014 and until the 31st of December 2018, the Romanian natural gas producers or their affiliates, according to the case, are obliged to sign transactions on the Romanian centralized markets, in a transparent and non-discriminatory manner, for the sale of a minimal amount of natural gas from their personal production, for domestic usage, in accordance with the regulations issued by the National Energy Regulatory Authority.

Starting with the 1st of March 2015 until the 31st of December 2018, licensed providers have the obligation to conclude transactions on the centralized markets, in a transparent and non-discriminatory manner, for the sale / purchase of a minimum quantity of natural gas, in accordance with regulations issued by the National Regulatory Authority in the Energy Field.

The failure and / or inadequate performance by natural gas producers in Romania, their affiliates but also their licensed suppliers, of the above mentioned obligations shall be sanctioned with a fine of 50,000 to 100,000 RON.
