ORDER NO. 80/2013 FOR THE APPROVAL OF THE GENERAL CONDITIONS ASSOCIATED TO THE ESTABLISHING AUTHORIZATION AND OF THE GENERAL CONDITIONS ASSOCIATED TO LICENSE FOR COMMERCIAL EXPLOITATION OF ELECTRICITY GENERATION CAPACITY AND, WHERE APPROPRIATE, THE HEAT PRODUCED IN COGENERATION

Order no. 80/2013 approves the General Conditions of validity of the establishing authorization, namely of the license for commercial exploitation of electricity generation capacity and, where appropriate, the heat produced in cogeneration. As well, are provided the rights and obligations of the authorization and license holders.
The license object is represented by the conduction of the activity of producing electricity and, wherever the case, by the heat produced in cogeneration, by the commercial exploitation of electricity production capacities and production capabilities of thermal energy cogeneration, except the following situations:
  • The supply of electricity to final customers, except the ones supplied directly related from the electrical installations related to the electricity production unit or form the electrical networks that exploit and places belonging to the licensee with electricity and / or heat obtained from its own production;
  • The distribution of electricity, except the activity of electricity distribution, including the provision of conversion services and / or connection for the network operators or for the electricity supply to the existing final customers, connected directly to the electrical installations associated to the electricity generation unit;
  • Consultancy, financing and execution of certain works / services to final customers;
  • Any other activities that do not fall into the categories of activities permitted or required by the license terms.
