LAW NO. 4/2014 FOR THE AMENDMENT OF O.U.G. NO. 44/2008 REGARDING THE DEVELOPMENT OF THE ECONOMIC ACTIVITIES BY THE AUTHORIZED PHYSICAL PERSONS (PFA), INDIVIDUAL ENTERPRISES AND FAMILY ENTERPRISES

According with the new legislative amendments brought by O.U.G. no. 44/2008,

the husband or the wife of the holder of the Individual Enterprise or of the PFA who participates regularly at its activity, accomplishing either the same duties, either complementary ones, shall have to register their activity before the Trade Register, through a Declaration on their own responsibility and the marriage certificate which attests the affiliation with the holder of that entity.
Equally, the ceasing of the activity developed by the husband or by the wife of the holder of the Individual Enterprise or of the PFA shall be mentioned as well in the Trade Register
within 15 days, on the basis of a Declaration on their own responsibility of the holder of the Individual Enterprise or of the PFA.

Following the registration before the Trade Register,

the husband or the wife of the holder of the Individual Enterprise or of the PFA may opt for ensuring in the public pension system, in the one of unemployment insurance and employment stimulation, namely in the health insurance system, in accordance with the legislation in force.
The new regulations introduced by Law no. 4/2014 transpose in the national legislation the provisions of the Directive 2010/41/UE of the European Parliament and the Council of 7th of
July 2010 regarding the application of the principle of equal treatment between men and women engaged in an independent activity and for the revocation of the Directive 86/613/CEE of the
Council.
