THE LAW NO 18/2014 CREATES A REGULATORY FRAMEWORK MORE CLEARLY DEFINED AND STRUCTURED OF OCCASIONAL ACTIVITIES CARRIED OUT BY DAILY WORKERS, AS OPPOSED TO THE OLD LEGISLATION WHICH TREATED WITH SUPERFICIALITY AND MINIMALISM THIS LABORERS CATEGORY.

Thus, in the new legislation concerning the daily workers activities, it shall be granted expressly the right to develop this kind of occasional activities on the Romanian territory to foreign citizens and stateless persons which has their domicile or, if is appropriate, their residence in Romania, in compliance with the Romanian legislation.

The minimum age to initiate the day laborers occasional activities is 16 years, except the cases in which minors’ workers aged between 15 and 16 years receive in advance the agreement of their parents or their legal representatives in this respect.

The remuneration attributed to daily workers for their services is modified, meaning that currently, the amount of gross hourly remuneration determined by the parties cannot be lower than the value/hour of the minimum gross wage guaranteed payment being paid at the end of each working day or of the working week. The remuneration payment proof shall be made with the day laborers signature into the Daily Workers Register.

In the same time, the new regulation gives an increased attention to the events during labor supply by daily laborers, followed by injury or death, in which case the recipient (the temporary employer) will be required to bear the necessary expenses of medical care or burial from its own funds, with the assumption that the employer have been found guilty in the occurrence of the event in question.
