GOVERNMENT DECISION NO. 855/2013 FOR THE APPROVAL OF THE METHODOLOGICAL NORMS FOR THE APPLICATION OF THE PROVISIONS OF LAW NO. 279/2005 REGARDING THE APPRENTICESHIP WORK

The employers who have the intention to pursue apprenticeship training programs are required to communicate the job vacancies available which are about to be filled by them, as well as the special conditions of access, to the County agencies for employment, respectively of the City of Bucharest under the jurisdiction of the registered office or their domicile. Job vacancies will be
displayed on the website of the Employment Agencies.

The apprenticeship contract shall include all the mandatory elements of the individual employment contract and it shall be concluded in written form, in Romanian language, and to be highlighted in the general register of employees under ‘CU’.

With regard to funding of professional training through apprenticeship, the employers who conclude apprenticeship contract can benefit, during their performance, on demand, of 60% of the value of the reference social indicator for unemployment and employment stimulation.

For granting these material benefits, within maximum 30 working days from the expiry of the probationary period contained in the apprenticeship contracts, the employers shall conclude with the Employment Agency a convention for each contract. The documents that employers shall submit for the conclusion of the convention are the following:
  • the identity card of the disciple, in copy and
  • the apprenticeship contract registered at the Labor Inspectorate, in copy.
The amounts allocated shall be granted to the employers throughout the entire duration of the apprenticeship contracts in proportion to the effective time worked by the apprentice, as well as for the period of annual leave. In this regard, the employers are required to submit the following documents to Employment Agencies:
  • Declaration of obligations to pay social contributions;
  • Income Tax Declaration;
  • Records of insured persons;
  • Nominal table of the employed disciples;
  • Daily log sheet for employees and payroll for the month of submission of documentation, in certified copy the employer;
  • Monitoring report of the work plan of the disciples, drawn by the apprenticeship coordinator.

Assuming that the above-mentioned documents are not filed within the statutory period for filing the declaration of obligations to pay social contributions, of the Income tax and the nominal record of insured persons for the month in question, the employers shall not benefit of the funding granted by the Employment Agency.

The amounts due to the employers shall be deducted from the contributions paid monthly unemployment insurance budget. If those amounts record higher values, the differences shall be recovered by the Agency for Employment from the unemployment insurance budget, within 5 working days from the 1st of the month following the deposit of declarations on social contributions, income tax and records of insured persons.
