THE DETAILED RULES FOR THE GRANTING OF COMPENSATIONS FOR FOREST OWNERS HAVE BEEN ADOPTED

ON 30 JUNE 2017, THE ROMANIAN GOVERNMENT HAS ADOPTED THE DETAILED RULES FOR THE GRANTING, USE AND CONTROL OF COMPENSATIONS REPRESENTING THE COUNTERPART OF THE PRODUCTS WHICH THE OWNERS OF FORESTS DO NOT HARVEST, DUE TO PROTECTION PURPOSES LAID DOWN BY THE FORESTRY LEGISLATION WHICH PROVIDES RESTRICTIONS FOR THE HARVESTING OF WOOD.

The financial compensations shall be granted to private owners (IMMs) which own forests where the harvesting of wood is restricted due to special protection functions (functional types T1 and T2, which meet environmental and protection objectives), according to the provisions of the forestry laws.
The normative act provides a scheme of state aid for which, as a result of the notification, the European Commission did not raise any objections. The Detailed Rules shall apply for the forest areas Natura 2000 or in areas which contribute to the implementation of Article 10 of the “Habitate” Directive.
On the elaboration of the normative act it was predicted that the forest owners will be able to bear the expenses generated by the administration of the forests, by the fit-up works, maintenance, management and protection of the trees, which in the absence of the revenues derived from the exploitation, shall be paid from the owners’ pockets. The allocation of such compensations to private forest owners contribute to the fulfillment of the obligations in respect to the management of a sustainable forest and, implicitly, to the fulfillment of the multiple economic, social and ecologic functions of the forests.
It is estimated that the compensations shall be granted to over 1000 private forest owners. For the granting of compensations, until the 30 June of each year, the solicitors must submit their applications at the headquarters of the Forest Guard (Garda Forestiera) to which they belong, along with the required documents pursuant to Art. 7(2) of the Decision.
For the year 2017, applications will be submitted within a maximum 90 days of the entry into force of the normative act.
