THE NEW LEGISLATION PACKAGE ON PUBLIC PROCUREMENT HAS BEEN PUBLISHED IN THE OFFICIAL JOURNAL ON THE 23RD OF MAY AND HAS ENTERED IN FORCE FROM MAY 26TH.

The main modification to the legislative framework concerns the taxation of a unique purchase document (the European DUAE), which is intended to reduce the pressure on the operators under the aspect of the qualification criteria. Also, the purpose is to reduce the acquisitions costs on a long term by the introduction of the concept called “value for money” in the award criteria. In this way, the State shall take into account the total cost for all the life cycle of the product or service to be bought in.
The thresholds of direct public procurement will remain, at least for the time being, unchanged, according to a legislative package recently published in the Official Journal, the novelty being that they will no longer be established in EUR, but in RON. The contracting authority shall have the right to purchase directly the products or services when the estimated value of the acquisition is less than 132.519 RON (about 30,000 EUR at the current rate RON- EUR), without VAT. In the case of the public works, the direct purchase will be established if the estimated value is less than 441.730 RON (about 100,000 EUR at the current rate RON- EUR), without VAT. Therefore, since the thresholds of direct public procurement direct will be laid down in RON, they will no longer be subject to movements in RON- EUR.
