THE COURT OF APPEAL IN TIMISOARA CITY, HAS CONSISTENTLY HELD BY THE CIVIL DECISION NO. 634 OF 14.09.2016, THAT IN THE ABSENCE OF A CLEAR AND UNEQUIVOCAL IDIOM, TO THE CONSUMER THE FOUNDATION OF PERCEIVING COMMISSIONS/FEES IS UNKNOWN, AND MAY INDUCE THE IDEA OF PERCEIVING MORE COSTS FOR THE SAME SERVICE OF THE BANK WITHOUT THE DISTINCTION BETWEEN THEM TO BE EXPRESSED CLEARLY.

Consequently, although the interest and commissions are part of the total cost of the contract, having blurred and unequivocally clauses governing the contract, may be the subject of analysis from the perspective of the abusive character.
