THE PENAL FINES APPLICABLE FOR THE LEGAL PERSONS ESTABLISHED BY THE NEW PENAL CODE

The New Penal Code brings some new elements in terms of penal liability of the legal persons, especially the penal fines.
Regarding the penal fines quantum, the New Penal Code imposed the dayfine system. Thus, the appropriate amount of a day-fine, between 100 and 5,000 lei, shall be multiply with the number of days-fine, which shall be contained between 30 days and 600 days.

The Court shall determine the number of days-fine, considering the general criteria of individualization of the penalty for deciding on the sentence, without exceeding the special limits provided by the New Penal Code, namely:

  • 60 – 180 days-fine, in case the law provides only the fine for the committed misdemeanor;
  • 120 – 240 days-fine, in case the law provides the prison penalty for at most 5 years, single or alternatively with the a penal fine;
  • 180 – 300 days-fine, when the law provides the prison penalty for at most 10 years;
  • 240 – 420 days-fine, when the law provides the prison penalty for at most 20 years;
  • 360 – 510 days-fine, when the law provides the prison penalty higher than 20 years or life imprisonment.


The amount corresponding to a day-fine shall be determined by taking into consideration the turnover for the profit legal entities, respectively the value of their assets for the other legal persons, as well as the others obligations provided into the task of the legal persons.

The Act has entered into force on 1th of February 2014
