THE EMERGENCY ORDINANCE NO. 52/ 2016 PROHIBITS DEBT COLLECTORS TO SEEK THE DEBTORS AT WORK OR TO CONTACT THEM BETWEEN 20.00 P.M. AND 9.00 A.M.

The fines go up to 100,000 RON. The Company’s representatives, specialized in recovery claims can no longer harass debtors; the legal provisions in the matter ban any kind of contacts at work or with other persons from the outside. It will not be permitted contacting borrowers between 20.00 p.m. and 9.00 a.m..
The Collectors will have a series of express prohibitions when it comes to contacting the citizens and communicating with them, the transgression of which shall be equal to the drastic punishment by the authorities. The provisions are to be found in the Government Emergency Ordinance no. 52/2016, which entered into force and they would aim the credits’ contracts with consumers. According to this normative act, it is completely prohibited to “contact, in connection with the claims recovery, of any other person different from the consumer, legal successors, lawyer or its representative, the creditor, the lawyer of the hearing officer of the creditor”. The use of any harassment or abuse technique, threats or other aggressive techniques, “with the purpose of harming physically or mentally the consumer, his relatives or to affect its reputation or property” is strictly prohibited.
